What is Domestic Violence in California?

Domestic violence in California refers to abusive behavior used to exert power or control over a partner, spouse, roommate, or family member. It can take many forms, including physical violence, emotional abuse, threats, or intimidation. When these charges are made, the criminal justice system can impose harsh penalties, even if the allegations are false or exaggerated. In California, domestic violence laws protect individuals from any form of abuse by someone with whom they have an intimate relationship. Whether you're accused of physical abuse, threats, harassment, or stalking, the penalties can be significant, including jail time, probation, mandatory counseling, and a permanent criminal record. Common charges include:

  • Physical abuse: Hitting, slapping, or other forms of bodily harm.
  • Verbal and emotional abuse: Threats, harassment, and intimidation.
  • Sexual abuse: Forcing sexual acts without consent.
  • Stalking or cyberstalking: Using technology or persistent behavior to intimidate.

Being charged with any of these crimes can affect more than just your criminal record. It can impact your family life, relationships, and career. That’s why having an experienced criminal defense lawyer is crucial to protecting your future.

California Sex Crime Attorneys for Felonies and Misdemeanors

The unfortunate reality of the nature of these charges is that alleged sex crimes often involve false accusations, and rarely involve witnesses. Behavior may be misinterpreted, or an angry individual may pose as a victim to get revenge against another party or gain the upper hand in a child custody case. These cases are extremely hard to defend as they involve substantial he-said-she-said accusations.

For this reason, it is absolutely essential to have a highly skilled defense attorney on your side before and during any trial for a sex crime in California’s courts. Our California law firm can work with you to understand the circumstances surrounding your case without judgment. We will keep you informed throughout the process, and will compile all evidence to see that your rights and your freedoms are protected.

If you retain our services, you can feel confident knowing that we will do everything in our power to fight for you while acting with compassion, professionalism, and efficiency. Don’t let your life be tarnished by wrongful accusations of sex offenses in California. Put our highly trusted legal professionals in your corner. For a free legal consultation with a sex crimes lawyer in California, contact The Law Offices of Bamieh & De Smeth, PLC at (805) 643-5555 today.

Voluntary Manslaughter

Voluntary manslaughter is the most serious manslaughter offense. This type of manslaughter occurs when the actor kills someone “upon a sudden quarrel or heat of passion.” That means that if you kill someone during a fight or because you were mad or provoked, you could be charged with voluntary manslaughter.

The law sees this heat of passion or quarrel as an excuse for the killing that reduces your culpability. If you intentionally kill someone, it is murder, but serious anger or a fight can cloud your judgment and reduce your fault in the death. For this reason, voluntary manslaughter is often used to “plea down” murder charges to a lesser offense if the actor was provoked into killing the victim.

Involuntary Manslaughter

Involuntary manslaughter occurs when you cause someone’s death while doing something illegal or that you knew was dangerous and could cause death. If you were in the process of committing a crime that was not a serious felony, and someone died, you are held responsible for their death with involuntary manslaughter charges. Additionally, if you ignore the dangers and consequences of a course of action and ultimately end up killing someone, you are similarly responsible for the death under this statute.

Vehicular Manslaughter

Vehicular manslaughter is similar to involuntary manslaughter, but it covers death involving the use of an automobile. This means that if you were committing a violation and killed someone in the accident or you did something extremely dangerous that caused someone’s death, you can be charged with vehicular manslaughter. This can also cover deaths involving the operation of a boat or other vessel.

There is an additional crime under Penal Code § 191.5 for gross vehicular manslaughter while intoxicated. This covers manslaughter that occurs in conjunction with a drunk driving offense, and it has higher penalties than typical vehicular manslaughter.

Theft and Robbery Charges We Can Help Protect Your Rights in Court

In California, larceny, embezzlement, and stealing have all been categorized under the umbrella term “theft crime,” and being arrested for any of them can be an embarrassing turn of events. Even if the alleged crimes involves a low-valued item, it may be enough to warrant an arrest or conviction. Your reputation depends on selecting the right legal representation.

If you have been arrested for a theft crime in California, you may feel like you’re under the harsh scrutiny of the law with no say in the matter. However, with the help of a criminal defense attorney from The Law Offices of Bamieh & De Smeth, PLC, you can fight your charges and protect your rights.
